Fairfax Child Support Modification Lawyer
There are two kinds of support that can be granted in divorce proceedings: child support and spousal support. The factors for determining these types of support are different, as are the factors for granting a modification. If you are seeking a support modification, or if you are opposing a petition for modification, I can help. The law firm of Michael A. Ward, P.C., Attorney at Law, provides skilled and attentive modification services.
Would you like to speak with a Virginia support modification attorney? Call me at 703-763-0896 for skilled assistance from a Fairfax child custody modification attorney with more than 30 years of experience. I can meet with you at my Northern Virginia office in Fairfax or my Central Virginia/Lynchburg-area office in Forest.
Child Support Modification
Initial determinations of child support are calculated using statutory guidelines. Child support modifications are also granted based on statutory guidelines. Whether you are paying child support or receiving support on behalf of your children, a skilled attorney such as myself can ensure modifications are granted when necessary. Child support modifications are based on a significant change in material circumstances, such as the following:
- Changing needs of the children
- Increase or decrease in one or both parents' incomes
- Child turns 18
- Child custody modification
Alimony Modification
Although not based on statutory guidelines, spousal support is also subject to modification. However, one important condition exists: Spousal support is not modifiable unless the parties agree and the original support agreement provides for modification. By working with my law firm, you can plan for a future unexpected event such as job loss or illness.
Voluntary unemployment or underemployment is another factor that can arise in spousal support determinations. Whenever necessary, I work with vocational experts and others who can obtain information about the individual's past work history. When one party hides income or intentionally does not work, alimony is affected.
My law firm looks forward to helping you obtain your desired outcome. Call me at 703-763-0896 or contact me online to schedule your consultation.
